I think the current version(s) of the documents are difficult to interpret and deal with. It is just hard to read and interpret what we have out there. My proposal is to consolidate the original Declaration of Covenants with its current nine Supplements and four Amendments as one new document. The same goes with the original Bylaws and its seven amendments. There will be no new amendments to either. I believe that there is a committee being established with John Gaston that is going to address this issue. I would like to be included. So I believe the issue is being addressed. Have you contacted the board about this? No, I have not, I seem to recall that you were designated as the point person. Need to be careful about any appearance of directing the HOA attorney about any services. Don't want to create an unauthorized billing obligation. Dan Stacy made clear that our brief telephone conversation on January 30th was non-billable. Mike P. He suggests that we should "Amend and Restate" the existing into one new document. An amended and restated declaration of covenants is a legal document that combines all changes to a declaration of covenants into a single document. It replaces the original declaration and any previous amendments. Any opinion? From: David Philips Sent: Monday, January 13, 2025 9:17 AM To: Dan Stacy Cc: Rebecca Blakely Subject: Tradition POA The Tradition Declaration and the POA Bylaws (PDF attached) were both adopted on December 29, 1994. In the thirty years since, the Declaration has been supplemented nine times and amended four. The Bylaws have seven amendments. This scattering makes for some confusion, especially with new owners. Is it possible and legal to merge/word process the various documents into one for re-recording? If so, I would welcome a proposal to present to our Board of Directors. Thanks.
